Help:Copyright legislations
This page is still under construction. Please do not initialize translations yet. |
This page in a nutshell: The goal of this page is to describe a model for storing copyright legislation on Wikidata |
Wikidata can be used as a database to determine which rules could apply. We shoould have information in wikidata for each jurisdiction.
National copyright aspects edit
Freedom of panorma edit
- freedom of panorama (Q918113), no list yet in Wikidata
Duration of copyright edit
Shorter term edit
- rule of the shorter term (Q1318221) list of countries can be find in countries which use the rule of the shorter term (Q61753997)
Scope of copyright edit
What is copyrightable differs slightly in each jurisdiction. fonts, governmental works etc. Can we query wikidata what is copyrightable?
Transfer to organisation edit
- Conditions differ whether copyright of works transfer to an organisation
Publication edit
When is a work published or unpublished can differ per country. We have an item for the German definition of publication: publication in German copyright law (Q15852766). A publication (Q732577) is legal handled by publication right (Q1285253) (when not published with permission from the rightholder is is copyright infringement (Q647578)). When a work is published after death of the author, it is a posthumous work (Q17518461). 25 years since publication of previously-unpublished posthumous work (Q29940790) might apply if legal published. gets Important for us is the first legal publication.
National laws edit
- current national copyright law (we didn't have an item for 'copyright law', we now have copyright act (Q63718677)). We need to add statements (jurisdiction, validity).
- we have the concept of copyright law in each territoy, and specific laws in each country. Commons also have items Copyright rules by territory, for now we assume that is the concept of copyright law in that country.
- we have items in wikibooks, wikisource, commons and wikipedia. we need to connect them.
Organisations edit
- Copyright offices
- Collective management organisations - see Help:Copyrights/Collecting societies for list and query
Court cases edit
- copyright court cases (we have a lot of them as wikipedia pages, but not structurised in Wikidata)
Modelling on country level edit
Countries / jurisdictions edit
- See https://www.wikidata.org/wiki/Help:Copyrights/Groupings_of_jurisdictions
- we should probably move from coutnry to jurisdictions as law can differ in regions of a country
- should we use the method is a list of (P360) -> country (Q6256) and add a list of countries in a porperty, or is there another modelling method. Will we do this also for example for list of countries with left-hand traffic (Q1846058)
