The judge determined that after the war the painting came into possession of the Dutch government and government officials mistakenly returned it to an international art dealer, which triggered a chain of events that led to the Bellotto being introduced to the museum's collection. Ellison ruled that under the Act of State doctrine, he couldn't interfere with the ownership of the painting, because the Dutch government committed the alleged error that landed the painting in Houston.
